《关于2015年部分节假日安排的通知》虽然规定2月18日除夕也放假,但因除夕放假仅属调休而非“法定节假日”。所以,实行标准工时制的用人单位安排劳动者在2015年除夕工作的,而又不能安排补休的,按不低于劳动者本人日或小时工资标准的200%支付工资。企业实行除夕至初六放假还是初一至初七放假,有自主权。按照《通知》规定,如果把除夕与初七作息时间对调,不违反法律规定,也不必支付加班费。
