《中华人民共和国消费者权益保护法》作为社会主义市场经济法律制度的重要组成部分之一,至今施行已接近14年,其在维护消费者合法权益方面作出了重大的贡献。然而在实施过程中也暴露了其不足。本文从立法与现实的冲突:消费者概念的模糊;期盼与实际的脱节:消费者协会功能的缺位;消费者与经营者的博弈:惩罚性条款的完善三个方面分析此法的缺憾,并在此基础上提出相应的完善对策,希望对完善《中华人民共和国消费者权益保护法》有所帮助。
