案例陈某于2007年4月15日到某机械公司上班,双方签订了5年期限的劳动合同,履行合同期间,公司为陈某参加了养老、医疗、工伤三种社会保险,且一直缴纳社保费。2011年下半年,机械公司因生产经营发生严重困难,决定按照法定程序裁减员工,陈某被列入了裁员名单之中。2011年11月18日公司提前与其解除了劳动合同,并按规定支付了经济补偿金。
