民用航空活动中发生的飞行事故往往是由于多种因素综合造成的,这些飞行事故大多不涉及刑事责任问题。发生飞行事故只有构成重大飞行事故罪才负刑事责任。重大飞行事故罪是指航空人员违反规章制度、致使发生重大飞行事故、造成严重后果的行为。构成本罪必须在犯罪的主体、客体、主观方面、客观方面具备刑法规定的犯罪构成的全部要件。鉴于航空业的特殊性,实践中应特别注意区分罪与非罪的界限。为了便于司法操作,建议对现行刑法关于本罪的规定做出相应修改。
Flight accidents in civil aviation activities are often caused by a combination of factors. Most of these incidents do not involve the issue of criminal liability. The occurrence of a flying accident constitutes a criminal offense only if it constitutes a major flight accident. The crime of major flight accident refers to the act of violating the rules and regulations of aviation personnel, resulting in a major flight accident and causing serious consequences. In order to constitute this crime, we must possess all the elements of a criminal offense stipulated in the criminal law in the subject, object, subjective and objective aspects of the crime. In view of the special nature of the aviation industry, special attention should be paid in practice to distinguish the boundaries of crime and non-crime. In order to facilitate judicial operation, it is suggested that the provisions of the existing criminal law on this crime be amended accordingly.
