《网络预约出租汽车经营服务管理暂行办法(征求意见稿)》规定专车平台应与驾驶员签订劳动合同,旋即引发争议。二者究竟应属何种法律关系,既涉及对专车平台进行性质界定的问题,也与采取何种认定标准有关。比较分析美国加州“博雷洛测试”标准、洛杉矶“奥康诺案”审查标准及我国劳动关系认定标准,以专车平台对驾驶员的实际控制程度为主要判定标准,结合对其他相关因素的综合考量,将助益于解决实践中二者法律关系的认定难题。
