新闻报道应准确使用法律术语。常见的错误用法有以下几种: (一)违法和犯罪的混用。人们习惯上说的犯法,法学上称为违法。违法是指违反国家颁布的各种法律、法令、法规的行为。违法行为不一定是犯罪行为,当违法行为还没有达到相当严重程度时,即没有达到触犯刑法规定,应当受到刑罚的处罚时,就不是犯罪。犯罪必须具备三个特征:①犯罪是危害社会的行为;②犯罪是违反刑法的行为;③犯罪是应受刑罚处罚的行为。三者缺一,就不构成犯罪。是否受到刑罚处罚,是区别违法和犯罪的重要标志。
News reports should use legal terms accurately. Common mistakes in usage are the following: (A) the mix of crime and crime. People used to say that breaking the law, legally called illegal.
