我国现行宪法和基本法律均明文规定各族人民有使用本民族语言进行诉讼活动的权利,而司法实践中该项权利并未真正落实,尤其在程序方面尚未得到有效保障。由于目前缺乏统一的标准和规范,各地法院在处理有关案件时存在很大差异,形成各式各样的事实上的“双语司法”。笔者针对当前司法实践中存在的问题,试图作较为全面的分析和探讨,希望能在前人研究的基础上有所突破,以期引起社会各界对该问题的关注,并促进这一制度的完善。
Our current constitution and basic laws all expressly stipulate that people of all ethnic groups have the right to use their native languages for litigation. However, this right has not been fully implemented in judicial practice, and the procedural aspects have not yet been effectively guaranteed. Due to the current lack of uniform standards and norms, courts in various places have very different handling of relevant cases and have formed a wide range of de facto “bilingual justice”. The author attempts to make a more comprehensive analysis and discussion on the existing problems in judicial practice and hopes to make breakthroughs on the basis of previous studies in order to arouse the attention of all sectors of society and to promote the improvement of this system.
