本文从历史及现状入手,分析了法律中写入“根据宪法”的源起、可能的理由和造成的混乱及影响;然后从制宪权理论的角度出发,论证了作为立法机关的全国人民代表大会及其常务委员会行使国家立法权制定法律,本身具有正当性、合宪法性,在法律文本中不必写入“根据宪法,制定本法”的字样并说明了写入反而会导致更多不利的后果。如,不利于树立宪法权威,不能解决法律根据其他宪法性法律或其他法律制定的问题,不利于对法律的合宪性推定、违宪性审查,对于现行没有写入的法律提出挑战等。
