某公司职工韩文海在该单位连续工作12年。合同届满之时,单位发出了继续签订合同的意向书,韩文海在意向书中明确提出:同意续签并要求订立无固定期限的劳动合同。用人单位只同意与他签订为期3年的劳动合同,双方意向不一导致续签合同未成,该公司向韩文海发出终止劳动合同的通知书。韩文海遂向劳动争议仲裁部门申请仲裁,要求与该公司签订无固定期限劳动合同。《劳动合同法》第14条第12款第1项规定:劳动者在该用人单位连续工作满10年的,如果劳动者提出订立无固定期限的劳动合同,用人单位应当订立无固定期限的劳动合同。
