宪政可以说是中国近代化的舶来品,虽然我国古代也有与此相关的表述,但与我们现在理解的宪政的意义相去甚远。宪政是基督教幽暗意识的产物,基督教认为人性本恶,因此主张限制政府,限制权力,那么这样一个根植于欧美文化意识的制度在中国实行的初期一定会遭遇水土不服。宪政文化是一种复杂的社会文化,对它的考量应该放在文化的整体结构中去,而儒家文化恰是中国传统文化体系的核心,了解儒家文化是理解中国宪政环境的关键。
Constitutionalism can be said to be an imported product of China’s modernization. Although ancient China also had expressions related to this, it is far from the meaning of constitutionalism that we now understand. Constitutionalism is a product of the dark consciousness of Christianity. Christianity believes that human nature is evil. Therefore, it advocates restriction of government and restriction of power. Therefore, such a system rooted in European and American cultural awareness will inevitably encounter acclimatization in China. Constitutional culture is a complex social culture. Its consideration should be placed on the overall structure of culture. Confucian culture is just the core of China’s traditional cultural system. Understanding the Confucian culture is the key to understanding the constitutional environment of China.
