在网络时代,作为各国行政法治主流模式的代议制民主,因其固有的局限,呈现出明显的弊端。为了弥补代议制民主的不足,参与式民主作为一种行政法治的新范式,将成为历史的必然。参与式民主能最大限度地保障公民的参与权利,但其一直被认为是微观民主,无法上升到国家层面。互联网的普及,打破了地域和国别的界限,有效地消除了阻碍参与式民主的信息不对称和规模限制,构建了公民广泛参与行政法治的平台。参与式民主的实现路径体现为公民知情权、参与权、表达权、监督权的保障。
In the Internet age, as the mainstream democracy in the country under the rule of law, representative democracy shows obvious disadvantages due to its inherent limitations. In order to make up for the lack of representative democracy, participatory democracy, as a new paradigm of administrative law and order, will become a historical necessity. Participatory democracy maximizes the rights of citizens to participate, but it has always been considered micro-democracy and can not rise to the national level. The popularization of the Internet has broken the boundary between regions and countries, effectively eliminated the information asymmetry and scale restrictions that impede participatory democracy, and established a platform for citizens to participate extensively in the administrative rule of law. The realization path of participatory democracy manifests as the guarantee of citizens’ right to know, participation, expression and supervision.
