年休假制度对于我国机关事业单位工作人员及一些国企的职工来说,并不陌生。1991年《关于职工年休制度的通知》、1994年《劳动法》和2005年《公务员法》都作了相应规定,但由于规定笼统,缺乏刚性约束,给实际操作带来诸多不便。以法定条例规范年休假而于今年1月1日施行的《职工带薪年休假条例》(以下简称“条例”)并没有带给劳动者多少惊喜,规定过于原则仍然是其最大的弊病……
The annual leave system is no stranger to the staff and workers of some state organs and public institutions as well as the employees of some state-owned enterprises. The 1991 Notice on Annual Leave System of Workers, the Labor Law of 1994 and the Civil Servant Law of 2005 all make corresponding provisions. However, due to the general provisions and the lack of rigid constraints, it brings much inconvenience to the practical operation. The “Regulations on Paid Annual Leave for Employees” (hereinafter referred to as the “Regulations”), which regulate the annual leave by statutory regulations, did not bring much surprise to workers.
