清真食品管理立法在我国是党和政府落实民族宗教政策的一个重要表现。20世纪80年代以来,我国部分省、市、自治区相继制定了管理清真食品的地方性法规、规章20余部,这些地方性法规、规章在一定程度上起到了尊重和保护少数民族风俗习惯、发展清真食品产业的作用。但由于清真食品立法工作目前尚处于尝试阶段,正在实施当中的一些地方性法规、规章在立法原则、清真界定、监管主体、人员构成等方面存在诸多不足之处,这些不足在实践中直接限制了清真食品产业的发展和壮大。本文通过介绍国内清真食品管理立法的现状,分析存在的立法难点问题和需要处理好的几个关系,并提出对这些问题的解决方案,希望对正在制订中的《国务院清真食品管理条例》以及今后的地方性立法提供借鉴和参考意义。
