为规范企业职工流动行为,保护用人单位与职工双方的合法权益,促进劳动力市场的健康发展,现就企业职工流动有关问题通知如下:一、在固定工制度向劳动合同制度转变过程中,用人单位与已经形成了劳动关系的职工,应当依法订立劳动合同,明确已有的权利义务关系。用人单位招(接)收的大中专毕业生,按有关规定签订了服务合同或其他协议的,未到期的仍应继续履行,并应与用人单位签订劳动合同;拒绝签订劳动合同又不履行协议的,在提前三十日以书面形式通知用人单位后,用人单位可与其解除劳动关系。劳动关系解除后,如原服务合同(协议)约定或用人单
