我国处在社会转型期,社会矛盾复杂多样,行政主体在行政过程中与行政相对人产生了大量的行政纠纷和行政矛盾,并潜在积累着社会大众对行政主体的不满,日益制约着行政主体职能的发挥和社会的稳定,不利于和谐社会的建设和经济的发展。本文在法社会学理论的指导下对行政主体行政过程中出现的行政纠纷和行政矛盾进行分析,运用法社会学的理论和方法,并结合公众参与理论,在现行中国特色社会主义法律体系范围内为行政纠纷的解决提供合理的制度设计和解决途径。
