土地使用权抵押是一种十分有效的担保方式，但是目前关于土地使用权抵押的立法还远远不能适应市场经济发展的要求，一方面，关于土地使用权抵押的规定在立法上不够衔接，甚至互相冲突；另一方面，关于土地使用权抵押的规定在立法上不够全面和明确。立法上存在的问题导致在实践中产生很多争议。结合土地管理的实际，对土地使用权抵押在立法上存在的几个问题进行了探讨并提出相应的对策 The mortgage of land use right is a very effective way of guarantee, but at present, the legislation about the mortgage of land use right is far from being able to meet the requirements of the development of market economy.
