我国不动产交易领域信息不对称、交易成本耗费现象严重,使市场失灵时有发生,影响经济效率增长,客观上要求健全相应的不动产法律制度。《物权法》设立预告登记制度正是在法律移植的基础上对我国不动产交易市场有效发展需求的一种回应,该项制度对相关主体的收益、成本情况产生了有利的影响,使社会总剩余增加,实现了经济改善,因此具有效率价值。本文指出为了更好地实现这一价值,现行不动产预告登记制度还需要在明确效力、扩大效力范围等若干方面加以完善。
