统筹城乡环境治理是我国城乡一体化的重要组成部分,只有合理规划城乡布局,统筹治理城乡环境治理立法,改变城乡二元结构,才能实现城乡全面、协调、可持续发展。我国地方环境治理存在部门保护主义和地方保护主义突出、立法能力不足、立法程序与宪法监督缺失等问题。因此,在统筹城乡环境治理立法过程中,必须协调行业利益与地方利益的关系,厘清中央与地方立法的权限,构建统筹城乡环境立法的利益协调机制以及相应的地方立法宪法监督制度。
The overall planning of urban and rural environmental governance is an important part of urban and rural integration in our country. Only by rationally planning the layout of urban and rural areas, treating urban and rural environmental governance as a whole and changing the dual structure of urban and rural areas can we achieve a comprehensive, coordinated and sustainable development of urban and rural areas. Local environmental governance in our country is characterized by prominent departmental protectionism and local protectionism, insufficient legislative capacity, lack of legislative procedure and constitutional supervision. Therefore, in the process of coordinating the legislation of urban and rural environmental governance, it is necessary to coordinate the relationship between industry interests and local interests, clarify the authority of the central and local legislation, establish the coordination mechanism of interest of urban and rural environmental legislation and corresponding local legislative constitutional supervision system.
