美国刑法理论与实践通常情况下对于违反法定作为义务的不作为者认定刑事责任。但这种不作为责任认定标准十分任意,亦十分模糊。事实上,只有坚持对于危害结果与不作为之间关系的一般道德理解,才能更好地解决这一问题。
The theory and practice of criminal law in the United States usually condemn criminal responsibility for the inaction of the statutory obligation. However, the standard of recognition of such omission is very arbitrary and vague. In fact, this issue can be better addressed only by upholding the general moral understanding of the relationship between endangerment and inaction.
