依法行政与宪政都是政治文明的重要内容 ,二者是相辅相成的关系。对依法行政的宪政分析应深入于 :从宪政的高度对行政权进行科学定位 ;树立“政府职责本位”的宪政观 ,进一步厘清行政权的实质和根源。社会转型对政府行政的时代要求乃是 :从全能政府到有限政府 ,从管制型行政转向服务型行政 ;促进行政控权机制和价值的新发展 ;加强反腐倡廉 ,健全监督体制和机制等。加强依法行政 ,促进中国特色社会主义宪政建设应包括 :建构诚信政府 ,强化人民政府为人民服务的根本责任 ;健全对抽象行政行为的司法审查制度 ,推进我国违宪审查制度及机制的建设和严格依法行政 ;加强行政程序法制建设 ,促进国家权力的规范化运行进程 ;发展非政府组织并加强其法律规制 ,增强市民社会的自治能力等。 Administration according to law and constitutional government are both important contents of political civilization. The two are mutually reinforcing relations. The constitutional analysis of the law-based administration should be deepened: the scientific positioning of administrative power should be carried out from the height of constitutional government; the constitutional concept of “the standard of government responsibility” should be further clarified and the essence and origin of administrative power should be clarified.
