保护少数民族权利和维护国家安全利益是当今世界各国面临的重大理论和实践问题。本文通过对威斯特伐利亚体系建立以来相关国际(人权)公(条)约的文本、语义和背景分析,指出少数民族权利保护与国家安全之间存在着历史同源性和逻辑相关性;少数民族权利保护和国家安全之间不存在绝对的正相关或负相关的对应关系;实践中少数民族权利保护能否产生有利于国家安全的后果,取决于若干中介性变量。
Protecting the rights of ethnic minorities and safeguarding national security interests are major theoretical and practical issues facing all countries in the world today. Based on the textual, semantic and background analysis of the relevant international (human rights) pacts since the establishment of the Westphalian System, this paper points out that there exists historical homology and logic correlation between the protection of minority rights and national security There is no absolute positive or negative correlation between the protection of minority rights and national security. Whether the protection of ethnic minority rights can benefit national security in practice depends on a number of intervening variables.
