市场经济条件下,鼓励劳动力的自由流动,但劳动者的自由择业全并不是随心所欲、不受任何限制的。本文以劳动合同中重要的服务期制度为视角,分析由于现行立法的不足,导致实践中关于服务期纠纷的大量出现,造成适法的困难,进而为完善我国服务期制度提出合理的立法建议。
Under the market economy, the labor force is encouraged to flow freely, but the free choice of workers is not arbitrary and unrestrained. This article takes the important service period system in labor contract as the angle of view, analyzes the insufficiency of current legislation, leads to the massive appearance of service period disputes in practice and causes the difficulties of lawfulness, and then puts forward reasonable legislative suggestions for perfecting the service period system in our country.
