涉不动产腾退案件一直是各地法院普遍反映的难办案件,该类案件的被执行人抵触情绪大且自动腾退率不高,部分执行依据存有瑕疵,案件较多涉及第三人,案件执行周期长且易引发信访,强制腾退在实施过程中的突发因素多。以集美法院的成功案例为分析范本,我们可从其中总结办理该类案件的六种方法。民事诉讼中,法院应当将不动产实际占有人追加为诉讼第三人,对当前普遍存在的未将实际占有人追加为诉讼第三人并判决其法律义务的情况,应当区分情况分类解决。
