北京大学的张平教授在谈到3G知识产权时认为,目前,在谈判中最关键的是要有人对于3G每种标准背后的专利池进行扎实的分析,这个工作量可想而知。张教授举例,在她本人发起的诉飞利浦DVD专利中一项专利为无效的研究中,仅科研经费就花了十几万元,而这一课题从2005年下半年开始,到2006年6月份结束,耗时近一年时间。由此3G三大标准所涉及的专利数量之大,需要的经费之巨可想而知。张教授提出了一个关键问题,这个分析由谁来做,一时之间是很难回答的。但是,在记者的采访中发现了一个可喜的现象,目前有的基础电信运营商开始委托第三方公司调查与3G及其相关业务方面的专利分布情况,有的则由自己的研究院来承担相关的工作,虽然,这种调查只是围绕着与运营商的业务相关的专利进行,但是对于以前从未意识到知识产权会使业务受到影响的运营商来说,这是一个巨大的进步。
