阿玛蒂亚.森的权利方法认为饥饿与饥荒产生的根源在于权利的剥夺,以及受个人或家庭的资源禀赋和交换权利的影响。阿玛蒂亚.森对传统福利经济学和诺齐克“自由至上主义”的纠正,使其权利方法强调严格的法律框架,但也局限了权利方法对饥荒的解释。为了弥补这个缺陷,权利方法需要新的视角,即关注非正式权利在粮食分配中的影响、关注非正式权利与法律之间的交互作用。
Amartya Sen’s rights approach considers the root causes of hunger and famine as deprivation of rights and the impact of the resource endowments and exchange of rights of individuals or families. Amartya Sen’s correction of traditional welfare economics and Nozick’s “supremacist doctrine” places emphasis on a rigorous legal framework for its rights approach but also limits the interpretation of famine by the rights approach. To remedy this shortcoming, the rights approach needs a new perspective, focusing on the impact of informal rights on food distribution and on the interaction between informal rights and law.
