法国采债权意思主义的物权变动模式,且有优先权这种特殊的担保物权形态,因此法国的抵押权和优先权的公示制度颇具特色。本文研究了法国抵押权和优先权的公示制度,全文由四个部分组成,第一部分探讨了法国不动产公示制度的历史沿革。法国不动产公示制度经历了一个漫长的修改和完善的过程。1955年1月4日法令是法国现行最为重要的不动产公示规则,它是法国不动产公示制度基本完善的标志。第二部分探讨了不动产公示的一般规则。不动产公示的前提条件是要符合相对效力原则和认证制度,公示一般要经过申请、审查、公示等程序。在不动产公示过程中,司法助理人员和登记员扮演了重要的角色。第三部分探讨了抵押权公示的具体程序,具体探讨了抵押权的申请、审核、续展、缩减和注销等程序。第四部分探讨了不动产优先权的特殊公示规则。
France adopts the mode of change of real right of creditor's rights, and has the privilege of such special form of security right. Therefore, the system of publicity of the mortgage and priority of France is quite distinctive. This paper studies the publicity system of French mortgage and priority. The full text consists of four parts. The first part discusses the historical evolution of French real estate publicity system. French real estate publicity system has undergone a long process of revision and improvement. The Decree of January 4, 1955, the most important immovable property regulation in existence in France, is a sign of the complete improvement of the real estate publicity system in France. The second part discusses the general rules of real estate publicity. The prerequisite for real estate publicity is to comply with the principle of relative effectiveness and certification system, publicity generally go through the application, review, publicity and other procedures. Judicial assistants and registrars play an important role in the real estate publicity process. The third part discusses the specific procedure of the publicity of the mortgage, specifically discusses the procedure of application, review, renewal, reduction and cancellation of the mortgage. The fourth part discusses the special publicity rules of real estate priority.
