《食品安全法》的立法目的是为保证食品安全,保障公众身体健康和生命安全,但食品生产经营活动环节众多、过程复杂,难免因某个环节的疏漏造成食品安全事故的发生,而一旦发生食品安全事故,将会造成一定的社会影响,政府和群众对食品安全事故均高度敏感,本文旨在通过探讨在餐饮服务环节发生食品安全事故时如何追究肇事单位的责任,并对其实施行政处罚,达到惩戒和警示作用,最大程度减少事故造成的社会影响,平息群众情绪,避免事故的再次发生,保障消费者就餐安全。
The purpose of the “Food Safety Law” is to ensure food safety and ensure the public’s health and life safety. However, there are many links in food production and management activities, and the process is complex. It is inevitable that food safety accidents will occur due to some omission in the process. Food safety accidents will cause certain social impacts. The government and the masses are highly sensitive to food safety incidents. This paper aims to investigate how to hold the perpetrators accountable and impose administrative penalties on food safety incidents through food service links , To achieve the role of discipline and warning, to minimize the social impact caused by the accident, to quell the emotions of the masses, to avoid the recurrence of accidents and protect the safety of consumers dining.
