日益增多的城市人口使本已稀缺的城市土地愈发供不应求,如何满足人类日益增长的土地需求成为了一个棘手的问题。但土地的立体利用,如高架铁路、空中走廊、地下停车场,为解决这一问题开辟了无限前景。笔者以一位法科生的角度认为,在法律上规范土地的立体利用十分必要,从《物权法》出发建议引入空间地上权制度。本文首先阐述空间地上权的概念及其法律性质;其次,多角度论述该制度引入我国后将产生的现实意义;最后论述在《物权法》中引入该制度的具体规定。
The growing urban population has made the supply of scarce urban land increasingly in short supply and how to meet the growing needs of mankind has become a thorny issue. However, the three-dimensional utilization of land, such as elevated railways, air corridors and underground parking lots, has opened up an infinite prospect for solving this problem. From the perspective of a law student, the author thinks it is necessary to standardize the three-dimensional utilization of land in law. From the “Property Law”, it is suggested to introduce the system of spatial right of land. This article first elaborates the concept and legal nature of the right to space in the land. Secondly, it expounds the practical significance that the system will bring to our country from a multi-angle perspective. Finally, it elaborates the specific provisions of introducing the system in the Property Law.
