我国关于劳动及劳动关系方面的立法与执行过程中间存在大量问题,如果不能妥善解决,将会制约国民经济健康持续快速发展。劳动合同是保护劳动者个人利益的一种有效法律依据;劳动法是保证劳动合同有效执行的法律依据;而处理好劳动关系则关系到社会的稳定与经济的持续发展。本文从我国劳动关系出现的问题入手,提出劳动法规存在的问题,并对这些问题进行法律社会学的分析,以探求有效解决问题的方法;从法律的功能、法律规范、劳动法法理分析、法律实际运行以及法律文化等方面进行法律社会学的思考,提出一些改善劳动关系看法。
There are a large number of problems in the process of legislation and implementation of labor and labor relations in our country. If not properly solved, the healthy and sustained development of the national economy will be restricted. Labor contracts are an effective legal basis for protecting the personal interests of workers. Labor law is the legal basis for ensuring the effective enforcement of labor contracts. Handling the labor relations is related to the social stability and the sustained economic development. This article starts with the problems that appeared in the labor relations in our country, puts forward the problems existing in the labor laws and regulations, and analyzes these problems from the aspects of law and sociology in order to find out the effective ways to solve the problems; from the function of law, the legal norms, the legal jurisprudence of labor law, Actual operation and legal culture and other aspects of legal sociology thinking, put forward some views on improving labor relations.
