中华人民共和国劳动法的通过和实施,标志着我国劳动制度的改革进入了一个新的阶段,即按照劳动法的规定,建立起适应社会主义市场经济的一整套劳动制度。由于我国正处于经济体制转轨的过程中,新旧体制交错,多种所有制企业共同进入市场,制定劳动法必须处理好多方面的矛盾和问题。在党中央的领导和关怀下,经过全国人大常委会、国务院以及方方面面同志的认真工作,一部适应社会主义市场经济的、有中国特色的劳动法终于诞生了。回顾这部法律制定过程中遇到和处理的几个主要问题,对理解和实施劳动法是有益的。一、关于劳动法的调整范围
The adoption and implementation of the Labor Law of the People’s Republic of China mark a new stage in the reform of the labor system in our country. That is, we have set up a set of labor system that is suitable for the socialist market economy in accordance with the provisions of the Labor Law. As China is in the process of economic transition, the old and new systems are staggered and various ownership enterprises enter the market together. Labor law must deal with many contradictions and problems. Under the leadership and care of the Central Party Committee, with the serious work of the NPC Standing Committee, the State Council and all quarters of comrades, a labor law with Chinese characteristics, which is adapted to the socialist market economy, was finally born.
