检察改革中对“人”的改革是重中之重。由于员额制和检察权能的复杂性,各试点检察机关在对现有检察人员进行分类管理的方案上,均不同程度背离了检察制度原理,陷入了误区。从当前具有检察官身份的人员中遴选出检察官的根本标准在于司法性和独立性。检察官是司法官,检察权是司法权,司法与行政的关系,检察一体与检察官独立的关系,都是检察人员分类改革需要厘清的问题。因此,办理法律规定的具有司法性、独立性、亲历性的检察事务才是检察官。履行检察职权的才是检察官,不在办案部门,不履行检察职权的,即便具有检察官身份,也不能认为是检察官。而遴选的方法必须通过择优选任。
Procuratorial Reform in the “people” reform is the most important. Due to the complexity of the post system and the power of procuratorial work, the pilot procuratorial organs deviated from the principle of the procuratorial system to varying degrees in the scheme of classifying the existing prosecutors into a misunderstanding. The basic criteria for the selection of prosecutors from among those currently serving as prosecutors are the judiciary and the independence. Prosecutor is a magistrate, procuratorial power is the judicial power, judicial and administrative relations, procuratorial and prosecutors independent relationship, are the prosecutors need to clarify the classification reform. Therefore, it is the prosecutor’s prosecutorial affairs that are legally, independently and vividly handled by law. To fulfill the procuratorial powers is the prosecutor, not the case handling department, do not perform prosecutorial powers, even as a prosecutor, nor as a prosecutor. The method of selection must be chosen by preference.
