目前我国在食品侵权责任方面以补偿性赔偿为主,《中华人民共和国食品安全法(草案)》(以下简称《食品安全法(草案)》)明确提出了惩罚性赔偿,成为一大亮点。论文将以“三鹿奶粉”为切入点,从目前中国的赔偿现状出发,引出对惩罚性赔偿的探讨。笔者从惩罚性赔偿与行政处罚及精神损害赔偿的关系、请求权基础、赔偿标准的影响因素、引发道德风险等角度,在现有的法学理论框架下对几个具体问题进行分析,提出自己的观点。
At present, China is mainly responsible for compensation for food tort liability. The “Food Safety Law of the People’s Republic of China (Draft)” (hereinafter referred to as the “Food Safety Law (Draft)”) clearly put forward punitive damages as a major bright spot. The dissertation will take “Sanlu milk powder ” as the entry point, starting from the current status of compensation in China, leading to the discussion of punitive damages. From the perspectives of the relationship between punitive damages and administrative penalties and compensation for moral damages, the basis of claims, the influencing factors of compensation standards and moral hazard, the author analyzes several specific problems under the existing legal theory framework and puts forward his own View.
