2008年“五一二”汶川地震发生后,涉灾犯罪问题、政府紧急权的行使问题、涉及地震影响案件可否援引情势变更制度、震后无主物的归属问题、国际救援问题、公司捐赠救灾的社会责任问题等成为学界乃至社会热议的话题。本刊特意组织的这六篇文章分别论述了以上问题,希望能对我国灾害防治法制建设和理论研究有所裨益。
After the “May 12” Wenchuan earthquake in 2008, the issue of crime-related crime, the exercise of government’s emergency right, the possibility of invoking the system of change of circumstances after the earthquake-affected cases, the ownership of non-essential materials after the earthquake, the issue of international aid, the company Social responsibility donated disaster relief and other issues become the hot topic of academic and social. The six articles deliberately organized by our magazine separately discussed the above problems and hoped that it would be beneficial to the legal construction and theoretical research on disaster prevention in our country.
