自从实行家庭联产承包责任制以来,农民生产积极性的提高已经极大地促进了农村生产力的发展,农村土地流转成为农村村民间进行交易的一种常态,成为一种经济形式,《农村土地承包法》、《物权法》等法律的实施,为调整农村土地流转关系提供了充分的法律依据。但是随着农民专业合作社的实施和发展,我国农业生产产业化进程的加快,农业市场化、国际化进程的深入,农村土地流转必将出现新的问题和态势,原有的法律调整机制在新的经济背景下将面临新的问题和挑战。在农村经济规模化、产业化发展的背景下,现有农村土地权利属性的确定、土地权属确定方式、现有农村土地不能设定抵押、本村土地如果承包给村集体经济组织以外的主体要经过村民的民主议定程序、土地入股后农民权益的保护等相关内容都需要与农村经济的产业化模式相协调。
