根据世界贸易组织(WTO)《与贸易有关的知识产权协议》(TRIPS协议)中有关规定,知识产权与货物贸易、服务贸易并重,成为WTO的三大支柱之一。近年来,随着知识经济的快速发展以及经济全球化进程的不断加快,知识产权作为体现一个国家核心竞争力的战略资源,已经成为推动全球经济发展的核心动力。知识产权领域的竞争已经成为国际竞争的一个焦点。为推动工业产权信息在全球范围的传播、交换、共享和有效利用,促进世界各国在工业产权信息和文献领域的国际合作,世界知识产权组织(以下简称WIPO)已经在工业产权标准化方面完成了涉及专利、商标和工业品外观设计的49个国际标准、建议和指南,向各国工业产权局、国际性专利组织推荐使用。这些工业产权国际标准、建议和指南(以下简称WIPO标准)正在推动着各工业产权局之间在加工涉及工业产权权利申请、审查、出版、授权和注册的电子数据方面向着协调性和一致性的方向发展。本文将从WIPO标准的管理机构和WIPO标准的主要内容两个方面对WIPO工业产权国际标准加以简要介绍。
According to the relevant provisions of the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), both intellectual property and trade in goods and services enjoy equal prominence and become one of the three pillars of the WTO. In recent years, with the rapid development of knowledge economy and the acceleration of economic globalization, intellectual property, as a strategic resource embodying a country’s core competitiveness, has become the core driving force for promoting global economic development. Competition in the field of intellectual property has become a focus of international competition. In order to promote the worldwide dissemination, exchange, sharing and efficient use of industrial property information and promote international cooperation in the field of industrial property information and documentation in the world, the World Intellectual Property Organization (WIPO) has completed the standardization of industrial property rights related to 49 international standards, recommendations and guidelines on patents, trademarks and industrial designs are recommended for use by national industrial property offices and international patent organizations. These International Standards, Recommendations and Guidelines on Industrial Property (hereinafter referred to as the WIPO Standards) are driving a coordinated and consistent process of processing of electronic data relating to the application, review, publication, authorization and registration of industrial property rights between industrial property offices The direction of development. This article will outline WIPO’s international standards for industrial property from both the governing body of the WIPO Standards and the main contents of the WIPO Standards.
