宪法是国家的根本大法,全国人民代表大会制定的法律不得与宪法规定相冲突,但是最近学术界有一种观点,认为只要是全国人民代表大会制定的法律,就不必遵守宪法的规定。产生这种错误观点的原因,是由于观点的持有者没有搞清楚法律的本质和宪法与法律的制定程序。法律的本质是由其执行的职能决定的;全国人民代表大会既是制宪机关,又是立法机关,全国人民代表大会在进行制宪议程的时候就是制宪机关,在进行立法议程的时候就是立法机关。
The Constitution is the fundamental law of the country. The laws enacted by the National People’s Congress must not conflict with the provisions of the Constitution. However, there is a view in academia recently that as long as it is a law enacted by the National People’s Congress, it is not necessary to abide by the provisions of the Constitution. The reason for this erroneous view is that the holder of the view did not understand the nature of the law and the constitutional and legal process. The essence of the law is determined by the functions it performs; the National People’s Congress is both a constitutional organ and a legislative organ. The National People’s Congress is the constitutional organ in carrying out the constitutional agenda and the legislature in carrying out the legislative agenda organ.
