市场集中,即市场经济力或市场支配力的集中,是市场中某行业的经济力量向某一企业或企业联合的集中。市场集中的程度通常以市场份领来衡量。市场集中的程度也就意味着垄断的程度。市场集中的其中一种途径就是数个企业通过联合或合并而急剧形成市场的集中。由于这种形式的市场集中蕴含着积极的经济意义,所以备受争议。在我国,相关市场和市场集中度的确认方式不一,因此,本文建议借鉴美国判例中所运用的方法,运用“五步分析法”确定市场集中度。此外结合案例运用五步分析法做为实例进行演示,来探讨市场集中度确定问题。
Market concentration, that is, the concentration of market economy power or market power, is the concentration of the economic power of an industry in a market on the joint enterprise or enterprise. Market concentration is usually measured by market share. The degree of market concentration also means the degree of monopoly. One of the ways markets are concentrated is the rapid concentration of markets by several firms through syndication or mergers. This type of market concentration is controversial because of its positive economic significance. In our country, the confirmation of market and market concentration varies from one to another. Therefore, this paper proposes to use the “five-step analysis method” to determine the market concentration by drawing lessons from the methods used in the U.S. jurisprudence. In addition, combined with the case of five-step analysis as an example to demonstrate, to explore the issue of market concentration.
