住宅建设用地使用权自动续期问题在自身规范缺失的情况下,以《物权法》第149条第1款的理解,可借助宪法规范而获得可能的解释路径。宪法视阈中住宅建设用地使用权自动续期的解释路径可以公民的财产权、住房权、平等权等宪法权利为切入点,寻求宪法权利的实现与既有土地制度框架体系的契合点。这就要求从理论上调适土地公有制与财产权之间的关系、国有土地有偿使用原则与公民有权以合适的价格获得住房之间的关系,并兼顾权利主体之间使用住宅用地的公平问题。
The issue of the automatic renewal of the right to use residential construction land, in the absence of its own norms, can be obtained through the interpretation of Article 149 (1) of the Real Right Law with the help of the constitutional norms. In the view of the Constitution, the path of interpretation of the automatic renewal of the right to use residential construction land can start with the constitutional rights of citizens, such as property rights, housing rights and equal rights, and seek the meeting point between the realization of constitutional rights and the existing land system framework. This requires that the relationship between public ownership of land and property should be adjusted theoretically. The principle of paid use of state-owned land and the right of citizens to acquire the housing at an appropriate price should be reconciled with the fair use of residential land between rights holders.
