劳动合同,是法律制度,也是人力资源管理的工具。法律关系和法律本身的复杂性,以及人力资源管理对象的差异性与多维性,常常意味着劳动合同“并入”了各种各样合同明示规定以外的默示条款。默示条款的出现,使得人力资源管理具有了弹性空间,管理效率得以提升,正因如此,默示条款具备了形式上的正当性。本文就默示条款进行了详细的叙述,并且分析了其就企业的人力资源管理存在的意义。
Labor contract is the legal system, but also human resources management tools. The complexity of legal relations and the law itself, as well as the diversity and multidimensionality of human resource management objects, often means that the labor contract “incorporates” the implied terms beyond the express provisions of various contracts. The emergence of the implied terms makes the human resources management has a flexible space, management efficiency can be improved, because of this, the implied terms have the formal legitimacy. This article describes the implied terms in detail, and analyzes its significance to human resource management in enterprises.
