第一章不动产登记制度及公证制度的基本理论第一节不动产登记制度概述不动产登记是,专门机关依据法定程序将不动产或者不动产权利记载或不记载于特定簿册上,进而产生特定法律结果的现象。不动产登记对不动产物权变动的法律意义在于:不动产登记,是不动产物权变动的法定公示手段,是因法律行为的物权变动的生效要件,也是物权依法获得承认和保护的基本根据。不动产物权的公信力主要取决于:物权公示制度、登记审查制度、物权行为制度。登记公信力的承认还应取决于登记审查制度,通过不动产物权登记来建立不动产物权支配秩序。
