2005年12月6日,WTO各成员一致通过了修改WTO《TRIPS协定》有关公共健康条款的决议,这是多哈发展议程启动以来到目前为止唯一经部长级会议确认的重要成果。修改后的《TRIPS协定》允许不享有专利权但已获得强制许可的国家以较低廉的价格把受专利保护的药品出口到没有或缺乏生产能力的贫穷国家。此项修改决定是《TRIPS协定》为发展中成员和最不发达成员提供的一项重要的灵活性,对我国正在进行的《专利法》的修改具有重要的指导意义。现将该决定和TRIPS理事会主席所作的《主席声明》翻译如下,供国内有关机构研究时参考。
On December 6, 2005, WTO members unanimously adopted the resolution to amend the WTO TRIPS Agreement on Public Health. This is the only important outcome so far confirmed by the ministerial meeting since the implementation of the Doha Development Agenda. The amended TRIPS Agreement allows countries that are not patented but have been granted a compulsory license to export their patented drugs at a cheaper price to poor countries that lack or lack productive capacity. This revision decision is an important flexibilities provided by the TRIPS Agreement for DMCs and the least developed members and is of great guiding significance to the ongoing revision of the Patent Law in our country. The decision and the “Chairman’s Statement” made by the chairman of the TRIPS Council are now translated as follows for reference by the relevant agencies in the country.
