我国《反垄断法》及其司法解释规定了“并行”的反垄断民事诉讼和反垄断行政执法的“二元”执行体制,反垄断民事诉讼的提起并不以反垄断行政执法程序的前置为前提,私人有权先后或者同时启动反垄断民事诉讼程序和反垄断行政执法程序。然而我国现有立法没有对两大执行程序间的衔接、协调机制作出规定,使司法实践中出现了程序竞合冲突、后续程序冲突等问题,降低了“二元”执行的效率。我国反垄断法立法目标的实现有赖于公私二元执行间的有效配合。

However, the existing legislation in our country did not stipulate the interface and coordination mechanism between the two executive procedures, which led to the conflict of procedural conflicts and follow-up procedures in the judicial practice, which reduced the efficiency of the implementation of “duality”. The realization of the legislative goal of antitrust law in our country depends on the effective cooperation between public-private dual enforcement.
