股份合作企业的设立与运作需要相应的法律来规范。在股份合作企业法尚未出 台之前，可由国务院通过制定行政法规对诸如股份合作企业的名称、法律地位。 出资人数、股权结构、出资方式、注册资本与组织机构等问题作出规定。
The establishment and operation of joint-stock cooperative enterprises need corresponding laws to regulate them. Before the promulgation of the joint-stock cooperative enterprise law, the State Council may enact laws and regulations on the name and legal status of enterprises such as joint-stock cooperative enterprises. The number of investors, ownership structure, means of investment, registered capital and organizational structure and other issues.
