德国土壤保护的法律体系健全,法律制度完善,形成了从区域间合作协议、联邦专门立法到州立法的多层次格局。《联邦土壤保护法》对我国具有重要借鉴意义,其设总则、原则与义务、污染场地的补充规定、农业土地利用、最终条款五部分,规定事前预防与事后控制,并形成了土壤污染调查评估、土壤信息传递、土壤污染修复责任等具体制度。我国土壤污染问题严峻,应当借鉴德国的立法模式,加快制定全国性的《土壤环境保护法》,鼓励地方积极制定有效的地方性法律,并健全完善我国的土壤环境保护制度。
The legal system of soil protection in Germany is sound and the legal system is perfected, forming a multi-level structure from the inter-regional cooperation agreement, the federal special legislation to the state legislature. The “Federal Soil Conservation Law” has important reference for our country. Its general principles, obligations and principles, supplemental provisions for contaminated sites, agricultural land use, and final clauses provide for the prevention and control of accidents and the formation of the Soil Pollution Investigation and Assessment , Soil information transmission, responsibility for soil remediation and other specific systems. Soil pollution in China is a serious problem. We should learn from Germany’s legislative model and speed up the development of a nationwide Law on the Protection of the Soil and Encourage Local Governments to actively formulate effective local laws and improve the soil environmental protection system in our country.
