在我国刑事诉讼程序中,部分涉案事实由特定单位提供证据材料日益成为一种普遍现象。然而,与现行民事诉讼法所不同的是,我国刑事诉讼法并未肯定单位的作证资格以及相应的法律地位。笔者认为,立法以及刑事司法实践中否定单位在我国刑事诉讼证明过程中作证资格和法律地位,对刑事司法实践中大量出现的单位提供证据材料的现象视而不见,既不利于及时有效的追究和惩罚犯罪,也不利于刑事诉讼证明理论体系的完善。为此,笔者在学界关于单位作证研究的基础上,结合个人思考,试图论证单位的作证能力,为刑事诉立法确立单位作证制度探索理论依据。
In China’s criminal procedure, some of the facts involved in the case of evidence provided by a particular unit is increasingly becoming a universal phenomenon. However, different from the existing civil procedural law, the Criminal Procedure Law of our country does not affirm the qualification of the unit and the corresponding legal status. The author believes that neglect of legislation and criminal judiciary in the process of proof of criminal procedure in our country to prove the status and legal status of the criminal justice practice a large number of units to provide evidence of the phenomenon of turning a blind eye, is not conducive to the timely and effective investigation and punishment of crime , But also not conducive to the improvement of theoretical system of criminal procedure. Therefore, on the basis of academic research on unit testimony, the author attempts to demonstrate the unit’s ability to testify in light of personal thinking and explore the theoretical basis for the establishment of unit testimony system for criminal prosecution.
