1990年哈佛大学肯尼迪政府学院的约瑟夫·奈教授提出“软实力”一词。软实力是为文化和政治的魅力、信息媒体传播的声誉和一种普遍的价值观的传播。近年来,各国对文化软实力及其保护的呼声越来越高。我国“儒学复兴”、“中国梦”等得到了世界的关注和称赞,但就事实来讲,我国的文化软实力及其保护仍比较靠后,保护知识产权仍是一个刻不容缓的课题,但同时又出现了一些要求知识产权保护利益均衡,批驳知识产权保护过度的声音,那么,知识产权的保护究竟是否合理,怎样保护知识产权才算合理,本文试图从法理学中权利和义务的角度对知识产权保护合理性进行阐释,并不希冀有何作为,只求能将一些理论作以梳理,供大家学习交流。
