“无效果无报酬”原则是海难救助制度中的特有原则,以效果衡量标准和报酬激励机制对遇难船舶及货物的救助起到了积极的促进作用。然则对财产救助的有偿设计打击了无偿救助人命的救助人的积极性,是对人命救助的忽视;“特别补偿”规定的例外也无法完全释放“无效果无报酬”原则对环境救助的压力,是对环境救助的忽视。必须在“无效果无报酬”原则的统摄下设置财产、人命和环境的三维客体以及三重价值体系才能构建起新时代下可持续发展的海难救助制度。 The principle of “no effect no reward ” is a unique principle in the salvage system, which has played a positive role in promoting the rescue of distressed ships and goods by measuring the effectiveness and reward incentives.
