个人信息承载着尊严与自由等消费者的基本需求,这些需求之间存在层次差异,而对信息的增值利用阻碍了需求的实现。为应对此困境,本文运用新制度经济学的方法并借鉴欧美立法经验,分析消费者权益保护法(2013年修正)之不足,并提出用立法来规制利用行为的思路;为实现思路,以尊严与自由为起点衍生出相应规则,探析不同规则的实施方式,据此统分结合地约束各利用者,从而体现前述需求的层次性,并具体回应增值利用的社会诉求。
Personal information carries the basic needs of consumers such as dignity and freedom. There are level differences between these needs, and the value-added use of information hinders the realization of the demand. In order to cope with this predicament, this article uses the method of new institutional economics and draws lessons from European and American legislative experiences to analyze the insufficiency of the Consumer Rights and Interests Protection Law (2013 Amendment) and puts forward the idea of using legislation to regulate the use of behavior. In order to realize the thinking, with dignity And freedom as the starting point to derive the corresponding rules and explore the implementation of different rules, thus binding the various users in a unified manner, so as to reflect the level of the aforementioned requirements and concretely respond to the social demands of value-added utilization.
