康德法学说中的自由貌似老生常谈,无任何新意可言,然而事实却是我国专业研究中对某些重要概念和段落的翻译和理解方面存在着普遍性的瑕疵。很自然地,对这些瑕疵进行修正是极为必要的。在康德的法学说中,自由作为唯一的内在性的、而非生而具有的法权,发挥着统摄性的功能,它支撑着私法、公法和国际法等。与此紧密相关的则是康德关于“文明状态仅仅被理解为法律的状态”的主张,它意味着法律应是对人的野蛮性的驯化和净化,而文明的品次则表现为对野蛮性进行规训的程度。充分意识到这一点对于我们这样一个法治不发达国家具有极为重要的意义。
The freedom in Kant’s jurisprudential doctrine seems plagued without any new idea, yet the fact is that there is a universal flaw in the translation and understanding of some important concepts and paragraphs in our professional studies. Naturally, it is imperative to correct these flaws. In Kant’s jurisprudence, freedom serves as the only internal rather than a born legal power, which plays an integral role in supporting private law, public law and international law. Closely related to this is Kant’s claim that “the state of civilization is merely understood as the state of law,” which means that law should be the domestication and purification of man’s brutality, while the quality of civilization manifests itself as Brutal degree of discipline. Fully aware of this point is extremely important to an underdeveloped country like the rule of law.
