一、引言纽伦堡审判是在国际法极不完善的情况下进行的,旨在核实纳粹当局所犯的历史罪行,同时改革和充实国际法,试图达到控制侵略战争、确保人类的持久和平,以及保护国际人权的目的。这次审判是一项艰巨而庞大的事业,是人类历史上运用司法手段制止侵略战争的第一次尝试。当时,国际法极其薄弱,没有现成规则赖以依据,没有任何先例可以遵循。但残酷的现实不容人们从容思考,等待法律完善后再付诸实施,而必须立即采取行动增强国际法的权威,率先用来制止战争。
